1. Single Agent
According to the Alabama Real Estate Brokerage Services Disclosure, a Single Agent is a licensee who represents only one party in a sale. That is, a Single Agent represents his/her Client. The Client may be either the Seller or the Buyer. A Single Agent must be completely loyal and faithful to the Client.
The practical application of Single Agency for Dean & Associates Inc shall be as follows:
- The Broker requires the delivery of a Proof of Funds document or Lender Pre-Approval Letter before the Broker will present a Buyer’s Agency Agreement for signature. The Broker will not present a Buyer’s Agency Agreement for signature with the understanding that their purchase will be contingent on the sale of another property(s).
- A Listing Agency Agreement will be required by all individuals requesting to list their property for sale.
2. Limited Consensual Dual Agency
According to the Alabama Real Estate Brokerage Services Disclosure, a Limited Consensual Dual Agent is a licensee for both the Buyer and the Seller. This may only be done with the written, informed consent of all parties. This type of Agent must also be loyal and faithful to the Client, except where the duties owed to the Clients conflict with one another.
The practical application of Limited Consensual Dual Agency for Dean & Associates Inc shall be as follows:
- When a Buyer (who has signed a Buyer’s Agency Agreement with the Broker) requests to view a property for sale that the Broker has listed, then the Broker shall require that both parties (Buyer and Seller) sign a Limited Consensual Dual Agency Agreement.
