Property Condition Listing Requirements

Alabama law requires Landlords to deliver the premises to the Tenant in a clean and safe condition, as defined by the Alabama Uniform Residential Landlord and Tenant Act (Ala. Code § 35-9A-101 et seq.). This includes complying with all building and housing codes that affect health or safety and making all repairs necessary to keep the property in a habitable condition.

The Broker defines “Clean and Safe” condition as including but not limited to:

  • Dryer Vents must be professionally cleaned as a fire prevention measure.
  • Carpets must be in good condition free of stains, worn spots, cuts, wrinkles, seam separations, etc. and professionally cleaned.
  • Drywall must be free of damage including but not limited to holes equal to or exceeding 1/4 inch in diameter and/or installed drywall anchors.
  • All windows must have blinds.  Curtains and curtain rods must be removed and walls must be repaired.
  • Hard surface floors must be in good condition and have been swept clean.
  • All personal property and garbage must be removed.
  • Debris must be removed from all drawers, cabinets, countertops and wiped clean free of stains
  • Lawn and landscaping must be in good condition and be HOA compliant.

Option 1: The Owner may order the cleaning services described above prior to listing the property with the Broker with the condition that they provide receipts for those services to the Broker and the receipts are from professional and appropriately credentialed Vendors.

Option 2: After the Broker and the Owner agree on the initial rental rate and the Owner approves quotes for cleaning and repair services a listing agreement may be signed. When the listing agreement is signed “coming soon” advertising may begin but showing will not start until all work is completed.
